This Privacy Policy applies to your use of the Text to Ticket mobile application (the “App”) and website, both of which are owned by Text to Ticket, Inc. (“Text to Ticket,” “we,” or “us”). We are committed to protecting your privacy, and this document is intended to inform you of the steps we take to ensure the security of your personal information we collect from you. By using the App or visiting our website, you consent to our collection and use of your information as described in this Privacy Policy. This policy describes

(i) The types of information we collect when you use our service;
(ii) How we use, share, and protect that information;
(iii) How long we retain that information; and
(iv) Your rights and options regarding the information we collect.

NOTE: This Privacy Policy further incorporated into and is subject to the Text to Ticket Terms of Service.

1. Information We Collect

When you register to use the Service, we collect the following types of information:

(a) Personally identifiable information (PII): PII is information that personally identifies one individual from another. You voluntarily provide this information to us when you sign up to receive our newsletter or create an account to use the App. When you join our mailing list, we will send you newsletters and promotional information. When you create an account, we ask you to provide us with the following elements of PII: (i) Name; and (ii) Email address.. If you upload a video while using the App, we will tie that video to your account, and any information you include in it will fall under the category of PII. If a video you uploaded is accepted, we will also ask you to provide the information required to make payments to you, which may include your bank account information, PayPal ID, or such other elements of financial information that our payment processors may require.

(i) Why do we collect PII? We use the PII we collect from and about you to identify you and tie you to any videos you upload. We use your email address to send you informational and promotional email messages. You may stop receiving nonaccount related emails from us by clicking the unsubscribe link at the bottom of the email. We also use PII to send you personalized account-related push notifications, such as whether your video has been accepted, when funds have been transmitted to your account, and other account-related information. With your consent, we may also use your phone number to send you informational text messages. You may opt-out of receiving text messages by following the instructions included with each text.

(b) General Information: General Information consists of information that is anonymous in nature and does not identify you as an individual. When you visit our Site, General Information is collected through a small piece of computer code called a “cookie,” and includes your computer IP address, unique mobile device identifier, browser type, ISP or carrier name, and the URL of the last webpage you visited before visiting our website. When you utilize the App, our server automatically records certain information, which is sent by your mobile device and stored in log files. This includes your mobile device push notification identifier, operating system, carrier name, and similar data. We will also record your unique device identifier ("UDI"), which is an alpha-numeric string of data that can either be part of the hardware of your device or automatically assigned to your device by the operating system or software.

(i) Why do we collect General Information? We collect General Information for statistical and other internal business purposes. Such information gives us insights on how you and other users utilize the App. We use this information to analyze and improve the App to ensure that our service continues to appeal to our users.

(c) Usage Information: We also collect information regarding the manner in which users utilize the App, such as application version, device manufacturer and OS version, timestamp, language used, and other statistical information.

(i) Why do we collect Usage Information? We use this information to ensure that our Service continues to appeal to our users, and for a number of other purposes, including auditing, research, and analysis in order to maintain, protect and improve the App; ensuring the technical functioning of the App; and developing new products.

(d) Location Tracking:The App may collect and process information about your actual location using various technologies, including IP address, GPS, and other sensors that may, for example, provide us with information on nearby devices, Wi-Fi access points and cell towers. The location-based service offered in the App is for individual use only and should not be used or relied on as an emergency locator system, used while driving, or operating vehicles, or used in connection with any hazardous environments requiring fail-safe performance, or any other situation in which the failure or inaccuracy of use of the location-based services could lead directly to death, personal injury, or severe physical or property damage.

(i) Why do we track your location? The App requires your location information for one or more features to work. Where the App does collect precise information about the location of your device, it will be used to provide location services for the App, and for other purposes, including, but not limited to, the provision of event-specific information. NOTE: If you disable GPS services for the App, you will not be able to submit eligible videos.

2. How We Share information.

We share information, including PII, with third parties in the following manner:

(a) We will share your PII and any videos you upload with local law enforcement authorities. As a consequence of this sharing, you may be contacted by the law enforcement authority with which your information has been shared. By using the App, you are permitting us to share your information and consent to be contacted by law enforcement.

(b) We may provide some PII and General Information to our subsidiaries, affiliated companies, or other businesses or persons for the purpose of processing and/or storing such information on our behalf. We require that these parties process such information with due diligence. We also use reasonable efforts to limit their use of such information and to use other appropriate confidentiality and security measures.

(c) If requested or required by other government authorities, such as courts or regulators, we may disclose any information we have about our users. We also may disclose your PII to exercise or protect legal rights or defend against legal claims.

(d) PII is considered an asset of our company, and if that asset is acquired by a third party, either through sale or bankruptcy, your PII will be transferred to the entity that acquires that asset. You acknowledge that such transfers may occur, and that any assets may continue to be used according to your PII as set forth in this policy.

3. How We Protect Information.

We understand the importance of keeping your information safe and secure, and utilize industry-standard data protection methods, including SSL data encryption, to ensure its safety. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. We cannot guarantee that your information will not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. We cannot assume responsibility or liability for unauthorized access to our servers and systems.

4. How Long We Keep Information.

We generally retain PII for five years after we acquire it; however we reserve the right to keep information for our internal business purposes for as long as we are legally permitted to do so. We may also choose to anonymize certain of the information you provide to us so that it can no longer be attributed to you if we would like to retain it for longer periods of time.

5. Your Options Regarding Informational Usage.

You may stop receiving non-account related emails from us by clicking on the unsubscribe link included in all such emails. You may decline to receive text messages or push notifications from us through your phone’s account settings. You may cancel your account by emailing a cancellation request to If you have submitted a video prior to cancelling your account, we will still retain your PII for five years after it was submitted. If you have not submitted a video, we will delete your PII one year after your account is canceled.

6. Children under 13.

Our App is not intended for users under the age of 13, and we do not knowingly collect PII from children under 13. If we become aware that someone submitting information is under 13, we will attempt to delete the information as soon as possible. According to our Terms of Service, all users represent that they are at least 13.

7. Online Tracking Technology and Do-Not-Track Requests.

We employ certain technologies such as Google Analytics that enable us to track your activities on our website over time, and to a certain extent across third-party websites. We do not utilize those technologies for tracking purposes, and offer no response to browser Do-Not-Track requests. You can prevent Google Analytics from recognizing you on return visits to this Site by disabling cookies on your browser.

8. Third-Party Links.

Our website may contain links to websites operated by third parties over which we have no control. Should you click on a link to a third-party website, the Privacy Policy of that website will solely apply to your activity. Text to Ticket offers no guarantees on the safety or suitability of websites featured on third party links, and any user who chooses to follow such links does so at his or her own risk.

9. For California Users.

In addition to the rights set forth in this Privacy Policy, Residents of California ("California Users"), may request information regarding the types of personal information we share with third parties for direct marketing purposes, and the identities of the third parties with whom we have shared such information during the immediately preceding calendar year. California Users may request further information about our compliance with this law by sending us a message via the Contact Us link on the Site. Please note that we are only required to respond to one request per customer each year concerning this law, and we are not required to respond to requests made by means other than through the Contact Us page on our website.

10. Changes to this Privacy Policy.

We reserve the right to amend, alter, or otherwise change this Privacy Policy at our sole and absolute discretion. If we make any changes regarding the disclosure of Personal Information to third parties, we will inform all registered Users, and post notice of the new Policy. Further use of the App following any such change constitutes your agreement to follow and be bound by the amended Privacy Policy.
